Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the Kissa Android app, this website and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, Community Guidelines and Refund Policy. These Terms are an electronic record under the Information Technology Act, 2000 and are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. Eligibility — 18+ only

You must be at least 18 years old and able to form a binding contract to create an account or use Kissa. You confirm this when you sign up. Accounts we find to belong to anyone under 18 will be closed. Kissa is a general story platform; it has no adult (18+) content category.

3. Your account

• You sign in with your mobile number and an OTP. Keep your phone and SIM secure; you are responsible for activity on your account.
• One person, one account. Don't share, sell or transfer accounts, or impersonate anyone.
• Tell us promptly if you think your account has been misused.

4. The service

Kissa lets you listen to audio stories and create your own from photos, voice recordings or text. Guests can listen to free episodes. Features, catalogue, languages and prices may change. We may limit features by creator tier, region or account standing.

5. AI-generated content

• Stories on Kissa are written and narrated with artificial intelligence (built on Sarvam AI) from material a creator provides, and reviewed and edited by that creator before publishing. Stories are labelled "AI-generated"; machine translations are labelled "Translated by AI".
• AI output can be inaccurate, inconsistent or unexpected, and translations or narration may contain errors. Stories are works of fiction or personal storytelling and are not statements of fact by Kissa.
• As a creator you are responsible for reviewing the AI draft and for what you choose to publish. You must not use AI features to create content that breaks our Community Guidelines, or to imitate real people or their voices.
• Our automated safety checks may block or send content for human review. They are a safeguard, not a guarantee, and don't shift your responsibility for your content.

6. Creator content and licence

6.1 You own your story

You keep ownership of the stories you create on Kissa and the photos, recordings and text you provide ("Your Content"), including your rights in the AI-assisted story to the extent the law recognises them.

6.2 Your promises

By uploading or publishing Your Content you warrant that:

• it is your original work, or you have all rights and permissions needed to use it;
• you own or have the right to use every image you upload, and any identifiable person in it has consented to its use — and no image shows a minor in any inappropriate context;
• any voice recording is your own voice, or that of someone who has consented, and own-voice narration uses only your own voice;
• it does not infringe anyone's copyright, trademark, privacy, publicity or other rights, does not defame anyone, and complies with our Community Guidelines and Indian law.

6.3 Licence you give Kissa

You grant Kissa a non-exclusive, worldwide, royalty-free (except for any creator payouts we offer), sublicensable licence, for as long as Your Content is on the Service and a reasonable period after for backups and legal compliance, to host, store, reproduce, process with AI, edit for format and length, translate into other languages, localise, narrate (including with synthetic voices), add music in experiments, publish, stream, make available for download in the app, display, promote (including using titles, covers and excerpts in marketing and share cards) and distribute it through the Service. Our service providers (such as Sarvam AI) may process it on our behalf.

You can unpublish or delete a story at any time; the licence ends for that story once it is removed, except for copies users have downloaded for offline listening until they next sync, backups, and records we must keep by law.

6.4 Drafts

Drafts are private until you publish. We don't publish anything you haven't chosen to publish.

7. Acceptable use

You must follow our Community Guidelines. In line with Rule 3(1)(b) of the IT Rules 2021, you must not host, upload, publish, transmit or share any content that:

• belongs to another person and you have no right to;
• is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or encourages money laundering or gambling;
• is harmful to children;
• infringes any patent, trademark, copyright or other proprietary right;
• deceives or misleads about its origin, or knowingly communicates misinformation;
• impersonates another person, including by imitating their voice;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites any offence;
• contains software viruses or code designed to interrupt or limit any computer resource;
• violates any law in force.

You also must not manipulate listens, likes or rankings (bots, device farms, paid listens), scrape the Service, reverse-engineer the app, bypass payments or access controls, or interfere with other users.

8. Coins, subscriptions and creation credits

• Free: the first 3 episodes of every story (or as shown) are free in every language. Translation is always free.
• Coins are bought in the app through Google Play Billing and used to unlock episodes. The coin price is shown before every unlock. An unlocked episode stays unlocked in every language. Coins are a limited licence, have no cash value, can't be transferred or exchanged for money and are not refundable except as required by law or our Refund Policy.
• Subscriptions (e.g. ₹49/month or ₹299/year) renew automatically through Google Play until you cancel in Google Play. You keep access until the end of the paid period.
• Creation credits are used to generate stories. Each action shows its credit cost first. Credits for failed generations are refunded automatically. Free starter credits have no cash value.
• Prices are in Indian rupees and include applicable taxes unless stated otherwise. Google Play's terms also apply.

9. Creator program

Creator tiers (Rising, Verified, Partner), slot limits, hit criteria and any payouts are described on our Creator program page and may change. Verified status requires KYC. Payouts, when launched, will be subject to separate creator payout terms, qualified-listen rules, fraud checks, holds and applicable taxes (TDS/GST). We may withhold or reverse amounts linked to fraud or policy violations.

10. Our intellectual property

The Kissa name, logo, app, website, design and software, and content we create, belong to Kissa or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial listening and creating, under these Terms. Downloads are for offline listening in the app only.

11. Reports, copyright and takedowns

Report content in the app or through our grievance form. We act on court orders and government notices within the timelines the IT Rules 2021 require, and on complaints about content that exposes a person's private area, shows them in full or partial nudity or in a sexual act, or is an impersonation, within 24 hours of receipt. Copyright owners may send a notice with details of the work and the content, and we may remove it and notify the creator, who may respond.

12. Suspension and termination

We may remove content, apply strikes, restrict features or suspend or terminate accounts that break these Terms or the Community Guidelines, or where the law requires. Three upheld strikes lead to a ban; some violations (such as child sexual abuse material or cloning another person's voice) lead to an immediate ban and may be reported to the authorities. You can stop using Kissa and delete your account at any time.

13. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't guarantee the Service will be uninterrupted, error-free, or that AI output will be accurate. Kissa acts as an intermediary for content published by creators.

14. Limitation of liability

To the extent permitted by law, Kissa is not liable for indirect, incidental, special or consequential losses, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim, or ₹1,000, whichever is higher. Nothing here limits liability that cannot be limited under law.

15. Indemnity

You agree to indemnify Kissa against claims, losses and costs arising from Your Content, your breach of these Terms or your violation of anyone's rights.

16. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer protection law, courts at the city of our registered office have exclusive jurisdiction. Please contact us first — most issues can be resolved quickly.

17. Changes

We may update these Terms. We'll update the date above and, for significant changes, tell you in the app before they apply. Continuing to use Kissa after that means you accept the new Terms. We will remind users of these Terms at least once a year, as the IT Rules 2021 require.
